Charities, CIOs and CICs

If you’re setting up a new charity, you’ll need a guiding hand to navigate you through the process. At Hodders Law, our commercial team led by Sherine Silva will advise you on the best legal structure for your organisation and manage the associated legal process for you.

What are my options when setting up a charity?

Depending on your charity’s objectives, there are a number of different organisational structures available. We are ideally placed to explain the features of each type of charity and help you decide what is best for you. There are three main types of charitable organisations:

• Charitable Incorporated Organisation (CIO)
• Community Interest Company (CIC)
• Unincorporated association or trust

Deciding which type of structure will suit your charity will depend on several factors such as how you want any property to be held; the size of the membership; who you want to take the decisions (members or trustees) and whether you want a company or the trustees to bear liability. Our specialist team understand that this is a big decision and will use their experience and knowledge of setting up many other charities to help you decide.

What do I need to do?

Whether you’re setting up a brand new charity or want to change the structure of an existing charity, there are several legal steps that we will guide you through. Indeed, you might want to give an existing commercial business charitable status. Depending on the type of structure, we will help you to register the charity with Companies House; write your Memorandum of Understanding, Articles of Association and put a trust deed in place. We will advise you on everything you need to do to properly and legally from your charity so that you can concentrate on making it a success.

Our Testimonials

“Dear Karen,

Thank you very much indeed for all that you, William Brown, and your support team at Hodders have done in connection with this purchase, and with the associated sale of Wallers Haven Barn. There were many times when I thought that we were not going to make one or the other, and it is in very large part down to your persistence that we are exchanged. Your care, patience and attention to detail have been much appreciated.
