Court of Protection Matters When an individual looses mental capacity to manage their own affairs and has not set up the appropriate Enduring Power of Attorney (pre October 2007) or Lasting Power of Attorney, an application must be made to the Court of Protection, for the appointment of a suitable representative to manage that person's property and affairs. This is an extremely bureaucratic exercise at a time of heightened stress for family. We can guide you through and deal with the due process involved. Powers of Attorney A Lasting Power of Attorney extends beyond property and affairs and also deals with personal welfare, giving you the opportunity to nominate who can make decisions about your health if you become seriously ill. The donor can also give a general power or restrict it. The Lasting Power of Attorney document must be registered with the court straight away and only comes into operation when the donor has lost mental capacity. A Lasting Power of Attorney is an essential document for those who have multiple assets. A General Power of Attorney is a document conferring power from the donor to attorney to allow the attorney the power to act on his/her behalf regarding his/her property and affairs. It may be general giving total power or restricted to a particular purpose. A General Power of Attorney is only effective for one year and is ineffective if the donor looses mental capacity. Trusts Trusts have the potential to save on tax and are also a useful tool to gift property into trust whilst maintaining control of the destiny of the property.
