Court of Protection & The Office of the Public Guardian

Hodders can assist you with any matters which are dealt with by the Office of the Public Guardian and the Court of Protection.

Both the Office of the Public Guardian (‘OPG’) and the Court of Protection (‘COP’) are government departments created to assist members of the public when dealing with their personal affairs.

The OPG deals with the registration of Enduring and Lasting Powers of Attorney. It is generally non-contentious and holds records of all of the Powers of Attorney that are registered. A search can be made to ascertain whether a person has made a power of attorney.

The COP looks after people who are no longer capable of looking after their own affairs. The COP deals with Deputyship applications and monitors Deputies as they manage the affairs of their Patient (the person on whose behalf the order has been made). The COP can also hold money for the Patient in the Court Funds Office.

The COP also deals with contentious matters. The COP is the court which deals with applications concerning disputes about the suitability of an Attorney or Deputy or if there has been financial abuse of a person with or without capacity to manage their own affairs. The COP is the court which also deals with Statutory Wills for people who no longer have the legal level of capacity to make a Will themselves.
