Enduring Powers of Attorney

Only Enduring Powers of Attorney made and signed before October 2007 can be enforced by law. If your loved one made one before the law changes, and they have now lost capacity, the attorneys (those nominated as representatives) will need to register the same so that the wishes can be followed.

As of October 2007, Enduring Powers of Attorney are now known as Lasting Powers of Attorney and they represent the same values. This means that any legally binding Enduring Powers of Attorney, nominate a specific person to carry out wishes in relation to health, financial affairs and general wellbeing.
